'İstinaf eden' veya 'temyiz eden' sadece resmi ve hukuki bağlamlarda kullanılır. 'İstinaf edenin beyanı' gibi ifadelerde görülür. Karşı taraf 'davacı/davalı' yerine 'yanıtlayan'dır.
